Welcome to our terms and conditions of sale and delivery.

This Website is operated by CruiseLife GmbH, whose registered address is CruiseLife GmbH, Löwengrasse 20, CH-8810 Horgen, Zurich, Switzerland. Throughout the site, the terms “CL” “we”, “us” and “our” refer to CruiseLife GmbH.

These are the terms and conditions of CruiseLife GmbH ("CruiseLife"), which is the company that sells goods to Customers on the Website. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

 

Please read these terms and conditions carefully before accessing and/or ordering any goods from the Website. You should print a copy of these terms and conditions for future reference.

How to order

1. Click on item you wish to buy from the Website.

2. Choose the size, colour and quantity you wish to purchase for the item. and click "Add to cart"

3. Review your bag by clicking on "view cart" and make sure all specifications such as quantity, size (see our sizing chart) and colour fit your requirements, then click "Checkout" 

4. You will be asked to enter your shipping details (email, name, address and phone number) and click "Continue" 

4a. If you have a promo code, select and enter it under "Enter promo code" in the Order Summary box. And the discount will be applied automatically. 

4.b If you wish to pay with Apple Pay click on the button on express check out. Where you will enter express check out with the details you have previously provided Apple.

4.c If you wish to pay with PayPal click on the button and you will be redirected to PayPal to log in and select your PayPal payment option. PayPal will then re-direct you back to our website to complete the purchase.

5. Select your preferred delivery method and click "Continue".

6. You will then proceed to the secure payment page where you may select the payment type and enter your card details to complete your order. Click "Continue" 

6.aYour billing address will be set up by default to your shipping address, should you wish to change this, un-tick the box and enter your billing details. and click "continue" 

7.  Review your order and click on "Place order".

 Your payment will be collected by CruiseLife GmbH. Following submission of your order you will be sent an automated order acknowledgement to the email address provided.

By placing an order through the Website, you warrant that you are legally capable of entering into binding contracts.

How the contract for the goods is formed between you and CruiseLife

Once you place your order with CruiseLife a contract to purchase the goods takes effect between you and CruiseLife. 

After placing your order, you will receive an email confirming that we have received your order. Once your order has been shipped you will receive another email confirming the shipment with courier name and tracking number. 

The contract to sell goods to you only relates to those goods listed in the confirmation email.

You will be charged once you place your order. In the event of us not being able to fulfil your order we will immediately issue a refund. We will process any refund due to you as soon as possible and, in any case within fourteen (14) days after the day we confirm via e-mail that you are entitled to a refund for defective items. The refund will be made to the same payment method originally used by you to make the payment.

Our goods

A description of the main characteristics of goods can be found on the product pages of the Website.

Prices for goods on the Website appear on the product pages and include all applicable taxes.

Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at our discretion. The prices on the Website may differ between countries.

The Website contains a large number of goods and it is possible that, despite our best efforts, some of the goods listed on the Website may be incorrectly priced. If we discover an error in the price of the goods you have ordered, we will inform you as soon as possible. We will give you the option of reconfirming your order at the correct price or cancelling it.

CruiseLife is under no obligation to sell incorrectly priced goods to you at the incorrect price.

Some offers carry a maximum quantity per customer. If this is applicable, this is detailed on the individual offer.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. 

All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 
 

Data protection and privacy

Any personal information provided to us will be processed in accordance with our privacy policy.

 

Purchases and payment

Customers must provide CruiseLife with complete and accurate details when making purchases. CruiseLife is not liable if we are given an incorrect delivery address at the time of purchase or returned goods. Any additional expenses in correcting the order are the responsibility of the customer.  

All of our prices are in GBP, CruiseLife is not responsible for varying currency conversion rates charged by customers’ banks.

Payment or debiting of your credit/debit card will be completed when you accept to complete the transaction at checkout. CruiseLife uses the WIX for all online credit card transactions. Wix Payments is a PCI-DSS Certified Gateway. Your credit card number cannot be viewed by CruiseLife or any third party.

We take a firm stance against credit card fraud. If your transaction is flagged in our system or suspected fraud, we will check your order by phoning you on the given number or email to ensure that the purchase has been made by the credit card holder. If we find anyone trying to use another person's details, CruiseLife will report all transaction information to the Australian Federal Police and banking authorities.

Please ensure if you are using a credit card that you provide the card holder's name as it is shown on the card, and the billing address corresponds as it appears on the card statement. Payment will be taken in GB pounds (£), and if applicable, your card will be charged according to the exchange rate at that time.

 

Gift cards

Gift Cards can be redeemed in our online store. Gift Cards may be exchanged for goods of a higher price than the value stored on the card on payment of the difference. If you do not spend the entire balance on the Gift Card the remaining balance will be stored on the Gift Card. No cash change will be given. Gift Cards may not be refunded, exchanged for cash, used as payment with discount vouchers or taken as deposits. Please treat Gift Cards as cash, we will not accept liability for lost, stolen or damaged cards. Gift Cards are valid for 24 months after purchase. Any balance remaining after expiration of the validity period will be cancelled.

Gift Cards cannot be used to buy further Gift Cards.

Gift Cards cannot be used to purchase goods for delivery outside of the UK.

 

Fraud Prevention

To help us to prevent fraud, we may require documentation to verify a customer’s details or may require a landline telephone number. Card Fraud is illegal, and perpetrators will be prosecuted.

The following documentation may be required to complete our due diligence checks –

Personal identification - Photo ID - (Passport, Driving Licence or Birth Certificate)

Front and back of all cards used on the account

Please remember to block out the middle 6 digits on the front of the card, and the 3-digit CVS on the back.

Failure to comply with the verification checks will result in the order being cancelled

We reserve the right to cancel any order we do not believe to be genuine

If we identify a transaction as being potentially fraudulent, we may ask our courier to return the goods to our warehouse, we may cancel your order even though you will have received the Order Confirmation email.

Promotions and discounts

Promotional sales may exclude selected styles and the purchase of Gift Cards. All styles will be marked down if included in a promotion unless a discount code is required, in which case the final price will display once the code has been entered correctly at checkout. Only one discount code can be applied to an order. Discount codes must be entered at checkout and cannot be redeemed after this point. CruiseLife reserves the right to change or end a promotion at any time without notice.

 

Instagram Giveaways

Any competition or giveaway promoted by CruiseLife is in no way sponsored, endorsed or administered by, or associated with Instagram, Inc. By entering, entrants confirm they are 16+ years of age, release Instagram of responsibility and agree to Instagram's terms of use. Winners will be contacted via DM on Instagram and will also be announced in the caption of the original post on CruiseLife’s account. Prize fulfilment is subject to availability and may differ from promotional images and information. CruiseLife reserves the right to substitute a prize of equal or greater value for the prize in its sole discretion, unless such substitution is prohibited by law. Prizes are non-transferable and CruiseLife need not substitute a prize based on a winner’s request.

 

TIKTOK Giveaways

Any competition or giveaway promoted by CruiseLife is in no way sponsored, endorsed or administered by, or associated with TikTok Inc. By entering, entrants confirm they are 18+ years of age, release TikTok Inc. of responsibility and agree to TikTok's terms of use. Winners will be contacted via DM on TikTok and will also be announced in the comments of the original post on CruiseLife’s account. Prize fulfilment is subject to availability and may differ from promotional images and information. CruiseLife reserves the right to substitute a prize of equal or greater value for the prize in its sole discretion, unless such substitution is prohibited by law. Prizes are non-transferable and CruiseLife need not substitute a prize based on a winner’s request.

 

Order Processing

Orders are processed on business days (Monday through Friday) during working hours excluding public holidays in UK.

Delivery Price

Delivery costs are additional to the displayed price and vary depending on the delivery service you select, the country of delivery and the quantity/weight of goods ordered.

If your order is particularly heavy it may be subject to extra delivery charges. If any order is subject to extra delivery charges you will be advised of the additional cost before delivery of your order begins. You have the option to cancel the order if you do not wish to pay any additional delivery costs.

Please note we are currently unable to deliver to PO Boxes.

 

Delivery of Pre-Order Items

If you pre-order goods with a launch date, then we will reserve your goods and hold the whole order until the day before the launch date. We will dispatch the pre-ordered goods via standard delivery the day of the launch date, if delivery is within the UK.

 

Split delivery

We may split delivery of your order into several parcels based on stock availability. You will not be charged extra for this method of shipping. Any additional consignments for delivery in the UK will be sent using the "UK Delivery option: standard delivery".

 

Free delivery offers

Free delivery offers, when available, only apply to orders for delivery to the UK Mainland (which excludes the Shetland Isles, Outer Hebrides, Guernsey, Jersey, Isle of Wight, Isle of Man, Isle of Scilly and Northern Ireland). Free delivery offers are sent using Standard Delivery service. Free delivery offers cannot be used in conjunction with any other offer, promotion or discount code.

 

Cancellation Policy

You can cancel an order within any time before shipping is confirmed. In which case we will send you an email to confirm your order has been cancelled and payment will be fully refunded. If you wish to cancel past this period, you will have to return your order to us and return policies apply.

Special conditions:

Customisable and bespoke items: given that these garments are customised, it is not possible to cancel purchases, exchange or return these items. 

 

Notifying about cancellation

For items returned within the cancellation period, you must notify us as soon as possible at: contact@cruiselife.com or through our contact form.

Please give us a clear statement that you would like to cancel which includes your name, address, details of the order you wish to cancel and some contact information such as a telephone number or email address.

 

Return Policy 

We have a 14-day return policy, which means you have 14 days after receiving your items to request a return. Followed by 14 days from the date of notification to return the items back to us.


To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging where it forms part of the goods, for example, boxed garments and gift items. 

and must follow the conditions for returns stated in these Policy. You may also need the receipt or proof of purchase. 


To start a return, you can contact us at contact@cruiselife.com, alternatively visit our contact page. If your return is accepted, we’ll send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. 

 

Items returns to us are sent at your own cost and risk.

You have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, CruiseLife may have a right of action against you for compensation. This applies to all items that are returned.​

We aim to process all returns as quickly as possible and you should receive confirmation of this within a week of having returned the item. 

 

 

Conditions for returns

Due to their special features, some of our items have to fulfil certain criteria to be returned.

  • Swimwear: must include the hygiene sticker.

  • Underwear:

    • Woman: can be returned or exchanged as long as they are in the same condition as when they were purchased and still have the bag or protective sticker with which they were sent. 

    • Man: underwear cannot be returned or exchanged.

    • Kids: underwear items cannot be returned or exchanged, except for socks, tights, tops, bodysuits and vests kept in their original packaging. 

  • Pyjamas: can be returned or exchanged as long as they are in the same condition as when they were purchased. Items that include a bag must be returned with it.

  • Accessories: must be returned with the bag or the original cardboard packaging intact.

  • Cosmetics: must be returned in the original sealed packaging and in original condition.

  • Special packaging and additional accessories: items sent with special packaging (fabric bags, special boxes, suit carriers, etc...) or additional accessories must be returned with said packaging or accessories in the same condition.

You can return any item ordered online in accordance with the terms in this section, apart from:

  • deposits and gift cards.

  • Customisable or bespoke items (including but not limited to: made-to-measure/order goods);

  • any items that are sealed for health protection or hygiene reasons if you have unsealed them (including but not limited to: underwear, personal grooming products, and swimwear);

  • any items that have been inseparably mixed after delivery.

  • unless they are faulty, damaged upon delivery or incorrect.

  • Where you have failed to take reasonable care of the goods, we reserve the right to refuse a refund and return the goods to you at your own cost.

 

Return period for split orders

If your order consists of multiple items or parts which are delivered on different days, then the cancellation period (in respect of your whole order) ends on the day 14 after the day on which the last of the items or parts are delivered to you (or someone receives the items for you)

How to items back?

You must return your items by post to the returns address no later than 14 days after the day on which the items are delivered to you (or someone receives the items for you).

Any returns are at your own risk. For your protection, we recommend that you return your items either by courier or by tracked post.

You must pay for any return delivery costs, except where the wrong item has been sent to you or the item is defective in which case we will provide you with the label to use for the package.

The items returned must comply with the criteria stated on this policy.

We will examine the returned items and notify you of your refund or repair or replacement via email within a reasonable period of time.



Returning items that have been sent out incorrectly

Should you receive any incorrect items, please get in touch with us as soon as possible at contact@cruiselife.com. Please clearly state on your message what you received instead of your order and whether you want to exchange for the correct item or return it for a refund. Where an item is confirmed as incorrect, we will then instruct you on how to send the item back.

If you are returning all items in your order and have chosen to get a refund, we will also refund the cost of the initial delivery to you, but only up to the cost of the standard delivery charge. We will not refund any Next Day, Express, Saturday or other premium component of any delivery charge. If you are not returning all the items in your order, the initial delivery cost will not be returned to you.

​Refunds Policy

We will refund you in full including delivery for any items cancelled within cancellation period. 

Once the items are shipped, we will refund you for any items you return, the delivery cost won't be returned to you. we reserve the right to deduct from any reimbursement an amount equal to any diminishment in value of the items as a result of you handling the items beyond what is necessary to establish the nature, characteristics and functioning of the items.

We will refund you using the same payment method originally used by you to make the payment (unless you have expressly agreed otherwise). You will be refunded no later than 14 days after the day we receive the items you are returning back from you. In case we cannot refund via the original payment then a cheque will be raised to the address on the order (except in the case of a full or part purchase of items using a Gift Card, as detailed below).

If any product purchased with a Gift Card is subsequently exchanged for a product of a lower price, any money owing will only be issued as a Gift Card. If your purchase was partially paid for on Gift Card and a refund is payable to you, your Gift Card will be refunded up to the card's original value, and any outstanding balance owed after this will be refunded via the other payment method originally used for your purchase. If you no longer have the Gift Card used to purchase the returned item(s), we will issue you with a new Gift Card to the value payable to you up to the amount of the card's original value.

​Once a refund has been issued you will receive a confirmation email detailing the amount which has been refunded and the item(s) we have received back. 

 

Defective items

In the unlikely event that you receive a defective item, please contact us at contact@cruiselife.com or use our contact form and include details where possible of:

• Your Order Number

• Product Code/Product Name

• Details of the fault

• Whether you would prefer a refund or a repair or replacement

Where an item is confirmed as faulty, please send the item  back to us using the return instructions. 

If you are returning all items in your order and have chosen to get a refund, we will also refund the cost of the initial delivery to you, but only up to the cost of the standard delivery charge. We will not refund any Next Day, Express, Saturday or other premium component of any delivery charge. If you are not returning all the items in your order, the initial delivery cost will not be returned to you.

Warranty and limitation of our liability

If CruiseLife fails to comply with these terms and conditions, CruiseLife shall only be liable to you for the purchase price of the goods and any proven losses that you suffer as a result of CruiseLife 's failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure.

CruiseLife will not be liable for losses that result from its failure to comply with these terms and conditions that fall into the following categories:

(a) loss of income or revenue;

(b) loss of business;

(c) loss of profits;

(d) loss of anticipated savings;

(e) loss of data; or

(f) waste of management or office time.

Nothing in these terms and conditions is intended to exclude or limit CruiseLife 's liability for:

(a) death or personal injury caused by CruiseLife 's negligence;

(b) fraud or fraudulent misrepresentation;

(c) any breach of the obligations implied by section 12 of the Sale of Goods Act 1979;

(d) defective products under the Consumer Protection Act 1987;

(e) any other matter for which it would be illegal for CruiseLife to exclude or attempt to exclude its liability.

Whilst CruiseLife adopts industry standard protections against computer viruses, it is not able to warrant that this website is free from computer viruses or any other malicious or impairing computer program.

Nothing in these terms and conditions is intended to affect your statutory rights.

Events outside our control

CruiseLife will not be liable or responsible for any failure to perform, or delay in performance of any of its obligations to you that is caused by events outside CruiseLife 's reasonable control (a "Force Majeure Event"). A Force Majeure Event includes any act, event, non-happening, omission or accident beyond CruiseLife 's reasonable control and includes (without limitation) the following:

(a) Strikes, lockouts or other industrial action;

(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;

(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;

(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

(e) Impossibility of the use of public or private telecommunications networks; or

(f) The acts, decrees, legislation, regulations or restrictions of any government.

In the event of a Force Majeure Event, CruiseLife 's performance is deemed to be suspended for the period that the Force Majeure Event continues, and CruiseLife will have an extension of time for performance for the duration of that period. CruiseLife will use its reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which its obligations to you may be performed despite the Force Majeure Event.

Written communications

Applicable laws require that some of the information or communications CruiseLife sends to you should be in writing. By accessing the Website, you accept that communication with CruiseLife will be primarily electronic through e-mail or notices posted on the Website. For contractual purposes, by accessing the Website you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that CruiseLife provides to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Intellectual property rights

Unless otherwise specified the intellectual property rights in the contents of all the pages in this website, are owned or licensed to CruiseLife GmbH, or are used with permission from the owner.

The contents of this website may not be copied, reproduced, modified, downloaded or used in any form without our prior written permission.

Complaints

CruiseLife takes all feedback very seriously and aims to deal with complaints as quickly and effectively as possible.

For complaints relating to orders placed through the Website please email customer services. To assist CruiseLife GmbH in dealing with your complaint, please detail all aspects of the complaint, your order number and your contact details.

Our right to vary these terms and conditions

CruiseLife reserves the right to revise and amend these terms and conditions from time to time. You will be subject to the terms and conditions that are in force at the time that you order goods from CruiseLife unless:

• any change to these terms and conditions is required to be made by law or governmental authority, in which case the changes may apply to orders previously placed by you; or

• CruiseLife notifies you of any changes to these terms and conditions before it accepts your order, in which case CruiseLife has the right to assume that you have accepted the change to the terms and conditions unless you notify CruiseLife to the contrary within seven (7) working days of receipt by you of the goods.

Governing law and jurisdiction

These terms and conditions shall be subject to English law.

The courts of England and Wales shall have exclusive jurisdiction over all claims or disputes (whether contractual or non-contractual) arising in relation to, out of or in connection with these terms and conditions including orders for goods.
